These Terms and Conditions of Sale shall govern the purchase of goods by you from IMPROVD DESIGN, LLC (hereinafter referred to as “IMPROVD”, “we” or “us”) through this website, IMPROVD.COM. These Terms and Conditions of Sale supersede any and all previous agreements and understandings between you and IMPROVD, and your use of this website to purchase merchandise indicates your agreement to be bound by these Terms and Conditions of Sale.

Orders

All orders will be confirmed by IMPROVD, in writing, by email. Merchandise displayed on this website may be out-of-stock or discontinued. IMPROVD reserves the right to refuse future orders when a customer has carried out an excessive number of returns beginning from the date of first return..

Color

We have made every effort to display as accurately as possible the colors of our products that appear on this website. However, as computer monitors vary, we cannot guarantee that your monitor's display of any color will be completely accurate.

Shipping

The products displayed on this website can be ordered and delivered only within the continental United States, including Hawaii and Alaska. All orders are shipped FedEx Home Delivery (ground), 2nd Day, or Standard Overnight and will require an adult signature upon delivery. Orders cannot be shipped to P.O. boxes or APO/FPO addresses, which are not available through FedEx. Orders made before 10 AM ET will be shipped the same day. To estimate the total delivery time for your purchase, please allow one to two business days to process your order for shipment, in addition to the time indicated by your preferred shipping method (i.e., FedEx overnight, second-day, ground). Orders are processed and delivered Monday through Saturday, excluding holidays. We cannot be held responsible for unanticipated delays. Except as otherwise provided for herein, you will be responsible for the shipping costs associated with the delivery of merchandise you purchase on this website. The shipping fee will be adjusted upon check-out based on the total weight, dimensions, and destination of your order. A confirmation email will be sent to you once your purchase has been shipped, which will include the tracking number of your shipment. If you are not completely satisfied with your purchase, or if there is a discrepancy with your order, please retain all documentation/packaging and contact us immediately by sending an email to customercare@improvd.com.

Delivery Promotions

Delivery promotions apply to standard delivery only. Free shipping applies to all orders being shipped within the continental United States, with the exclusion of Hawaii and Alaska, via our standard delivery service (3 - 5 working days). Free shipping does not apply to any other delivery service offered on this website.

Customs & Duty

Currently, IMPROVD only ships internationally on a case by case basis. Please contact IMPROVD’s customer service for availability at customercare@improvd.com. Please note that recipients of merchandise located outside of the continental U.S. will be responsible for any IMPORT DUTIES, CLEARANCE FEES, BROKERAGE FEES and any other additional fees, including but not limited to, duties, taxes and tariffs, incurred in connection with the delivery of merchandise outside the continental U.S. We operate on a DDU (Delivered Duty Unpaid) basis, which is managed by our carriers on a 'pay on delivery' basis. On occasion, goods may be subject to delay, due to customs or weather. The customer is also responsible for providing any information required by customs to ensure the goods are cleared. Please note that since the payment of CUSTOMS FEES and EXCISE DUTIES, and any other applicable duties, taxes and tariffs, are required by the country of the purchaser, we are unable to refund any duty, tax or tariff paid on any items returned to us for any reason.

Sales Tax

IMPROVD does not currently charge sales tax for items being delivered to any U.S. state with the exception of New York and New Jersey where customers are subject to the applicable state and local sales taxes, which will be added to their total order and to their shipping charges where appropriate.

Returns, Exchanges & Refunds

If for any reason you are not satisfied with your order, UNWORN, UNUSED items may be returned or exchanged within thirty (30) days of ship date. Returns made within fifteen (15) days of ship date are eligible for a full refund of the purchase price, exclusive of any shipping and handling costs or, where applicable, any foreign duties, taxes or tariffs paid by the customer. If your package arrives at IMPROVD within the fifteen (15) day time frame specified above, your refund will be processed in the original form of payment. Returns received by our warehouse after fifteen (15) days, but within thirty (30) days of the ship date, will be credited to the purchaser in the form of a store-credit for the value of the merchandise. IMPROVD does not refund any shipping or handling costs. The merchandise MUST be received by IMPROVD within thirty (30) days from the date of shipment of the order. Any item(s) received after thirty (30) days from the shipment date will not be accepted for return or exchange. Items for return/exchange should be shipped to:

Upon our receipt of merchandise, every effort will be made to ensure the prompt issuance of a refund, exchange or store-credit, as applicable. You will receive an email notification once your request has been processed. Please note that with respect to refunds, your banking institution may require additional days to process and post these transactions to your account once they have received the information from IMPROVD.Items received for return, or exchange, that are not in their original condition will be rejected and sent back to the customer. To qualify for a return or exchange, merchandise must be new, unused, undamaged, unsoiled, unaltered, and with all tags still attached.

IMPROVD EXPRESSLY DISCLAIMS ANY DUTY TO UPDATE OR REVISE THE MATERIALS ON THIS WEBSITE, ALTHOUGH IMPROVD MAY MODIFY THE MATERIALS AT ANY TIME WITHOUT NOTICE. YOUR USE OF THIS WEBSITE IS AT YOUR SOLE RISK, AND YOU ASSUME FULL RESPONSIBILITY FOR ANY COSTS ASSOCIATED WITH YOUR USE OF THIS WEBSITE. IMPROVD SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND RELATED TO YOUR USE OF THIS WEBSITE.

Promotions and Price Matching

Unfortunately, we cannot advise you in advance of whether the price of the item you purchased will be reduced in the future, nor will we reimburse you the difference after you have placed an order. Please note that we will not match the price of any IMPROVD items found in other stores or on other websites.

Disputes

In the unlikely event that there is a dispute in relation to the goods purchased, any dispute or claim shall be governed exclusively by the laws of the State of New York. If any provision of these Terms and Conditions of Sale is held by any Court or other authority to be invalid or unenforceable in whole or in part, then the validity of the rest of these Terms and Conditions of Sale and the remainder of the provision in question shall not be affected thereby. By purchasing goods from IMPROVD, you agree that the offer and sale of those goods takes place in, and will be governed exclusively by the laws of, the State of New York. You also agree that any legal or equitable claim against IMPROVD arising from or related to your purchase must be brought in the city, state or federal courts located in New York County, New York, and you consent to the exclusive jurisdiction and venue in such courts.

The terms and conditions of our Privacy Policy govern the processing of all personal data collected from you in connection with your purchase of merchandise on this website.
